In the Netherlands, the Mass Damage Settlement in Class Action Act (WAMCA) came into force on 1 January 2020.
The law, applicable to class actions related to events that occurred on or after November 15, 2016, introduced the possibility for foundations or associations with full legal capacity to claim damages on a class basis for victims based on an opt-out arrangement for Dutch residents and an opt-in scheme for parties established abroad.
In a class action, you allow yourself to be represented by an interest group. This interest group then demands compensation on behalf of everyone who has suffered damage.
